Understanding Workers’ Compensation In California

California’s workers’ compensation system gives employees the security of knowing that they will receive payment for their medical expenses and part of the income they lose if they experience a job-related injury or illness. Unlike personal injury lawsuits, workers’ comp claimants do not have to prove that their employer is to blame for the condition. Once the victim shows that their injury or illness resulted from the performance of their job duties, payment should be forthcoming. In exchange for providing this coverage, employers are shielded from personal injury litigation form their workers. However, workers’ compensation claimants might be able to collect pain and suffering damages and other types of compensation if a third party was responsible for their workplace accident or exposure. This is why you should hire an attorney with a strong track record in both workers’ compensation and personal injury cases.

Injuries associated with various workplaces

Our firm represents Central Valley and Central Coast residents in a full range of workers’ compensation matters, including claims related to:

  • Construction site accidents — Working on a construction site is often dangerous, and injuries from construction accidents can be life-changing, especially when they involve heavy equipment, electrocution or falls from high structures.
  • Medical problems related to shipping and receiving — Shipping, transporting and receiving cargo requires exceptional physical strength and stamina. Our firm assists victims of logistics accidents that occur in factories, on loading docks and while a truck is on the road.
  • First responder injuries — Police officers, fire fighters and emergency medical providers face various expected and unexpected hazards on the job. There are some special considerations in claims stemming from first responder injuries, so it is important to hire an attorney well versed in these cases.
  • Office worker injuries — Even employees who spend most of their day at a desk occasionally get hurt. When insurance companies question the validity of office worker injuries, we fight back on behalf of claimants.
  • Truck driver injuries — Operators of commercial vehicles could suffer a life-changing accident at any moment on the road. There are also other types of medical problems associated with truck driving, including spinal damage that results from handling cargo and various effects of spending countless hours sitting behind the wheel.
  • Nurse injuries — A nurse’s job requires a wide range of task and numerous potential hazards. Working in a hospital might lead to overexertion injuries caused by moving patients or heavy equipment. Nurses are also frequently exposed to contagious illnesses while fulfilling their professional duties.
  • Farm labor and packing house injuries — Whether you are working in the field or a packing house after crops have been harvested, the physical labor required to get produce from the farm to the table can be intense. Agriculture employees could require treatment for medication conditions linked to lifting heavy objects, exposure to hazardous substances, repetitive motion and accidents involving sharp blades.

No matter where you are employed or how you were injured, our firm offers the highest levels of representation and service for your workers’ compensation action.

Workers’ compensation requirements in California

California businesses and contractors must have valid workers’ compensation insurance even if they have only one employee. This coverage reimburses victims of work-related injuries and illnesses for the costs associated with their medical treatment, including rehabilitation expenses, hospital bills, medication and transportation to and from appointments. Claimants are also entitled to payments if they have lost wages because they are unable to do their job because of their medical condition. Compensation for total temporary disability equals two-thirds of the claimant’s average weekly earnings, up to a maximum set by the state. Surviving family members may also receive benefits, including reimbursement for final expenses, following a work-related death.

What to do if you are hurt at work

A successful workers’ compensation claim depends on prompt action and proper documentation. Once you are hurt at work, you should immediately report what happened to your supervisor or someone else in a position of authority. You should record what you remember about the incident and take photos of the scene if they help to explain what occurred. Your claim should be submitted within 30 days of the incident. Our experienced attorneys can help you prepare the required documentation and advise you on the medical information needed to support your case. In some instances, the insurance company could require you to see the medical provider of their choice to evaluate your condition. We offer knowledgeable guidance and advocacy throughout the workers’ compensation process and handle appeals of denied claims.
